Terms of Service

These Terms govern your use of the Hindsight mobile application and the services at gethindsightapp.com (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What Hindsight is

Hindsight is a trading journal and reflection tool. You log your trades manually or via an optional broker connection. The Service helps you visualize your performance, surface patterns, and review your decisions.

Hindsight is not a brokerage. We do not execute trades. We do not custody money. We do not provide investment advice, recommendations, or signals. Nothing in the Service is a solicitation to buy or sell any security.

2. Eligibility and accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. You are responsible for keeping your account credentials secure and for all activity under your account.

You may not create an account using false information, share your account, or use the Service on behalf of someone else without their consent.

3. Subscriptions and payments

Some features (including broker sync, Weekly Deep Analysis Recap, and unlimited history) require a paid subscription, currently:

• Hindsight Pro: $9 per month or $79 per year, auto-renewing
• Hindsight Max (planned): $29 per month or $269 per year, auto-renewing

Annual prices may change for new subscribers; existing subscribers continue at the price they signed up at unless we notify them in advance.

Subscriptions are billed through Apple's in-app purchase system. By subscribing, you authorize Apple to charge your Apple ID payment method on a recurring basis until you cancel. Manage or cancel subscriptions in your device's Settings → Apple ID → Subscriptions.

Refunds are handled by Apple, not by us. Apple's refund policy applies. We do not have direct access to issue refunds.

Free trials, if offered, automatically convert to paid subscriptions unless cancelled at least 24 hours before the trial ends.

4. Acceptable use

You agree not to:

• Use the Service for anything illegal, abusive, or harmful to others
• Reverse-engineer, decompile, or attempt to extract source code from the App
• Probe, scan, or test the security of the Service except via a coordinated disclosure
• Use the Service to transmit malware, phishing content, or spam
• Resell, sublicense, or commercially exploit the Service without written permission
• Use automated tools to scrape data from other users. There is no other-user data to access (the Service stores each user's data privately), but we still prohibit attempts.

We may suspend or terminate accounts that violate these rules.

5. Your data

You own the data you put into Hindsight (trades, notes, tags). We host it for you, process it to provide the Service, and delete it when you delete your account. Your data is governed by our Privacy Policy.

You grant us a limited license to host, process, and display your data only as needed to operate the Service. We do not use your trade data to train AI models. We do not sell your data.

You can export your data anytime via the in-app PDF export. For a more complete export, email us.

6. Broker connections (Pro feature)

If you connect a brokerage account via SnapTrade:

• You authorize Hindsight to fetch read-only trade and position data from your broker
• Authentication happens on your broker's site; we never see your broker password
• The connection can be revoked anytime in the App, at SnapTrade, or at your broker
• We are not responsible for errors, omissions, or delays in data provided by your broker or by SnapTrade

7. AI features

The Weekly Deep Analysis Recap (Pro feature) generates summaries using a third-party large language model (currently OpenAI). AI-generated text:

• May be wrong, incomplete, or misleading
• Is not investment advice or a recommendation
• Should be read as one perspective on your data, not a verdict

You are responsible for your own trading decisions. The Service helps you review them; it does not make them.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF DATA.

We do not guarantee that the Service will always be available, error-free, or fit for any particular purpose. Trade data displayed in the App may differ from your broker's records due to timing, fees, corporate actions, or upstream errors. Always reconcile against your broker's official statements before filing taxes or making decisions.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HINDSIGHT AND ITS OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR TRADING LOSSES, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE OR (B) USD $100.

You are solely responsible for your trading decisions and any gains or losses that result.

10. Indemnification

You agree to indemnify and hold harmless Hindsight and its operator from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your misuse of the Service or violation of these Terms.

11. Termination

You can terminate your account anytime in Settings → Delete account.

We may terminate or suspend your account for violations of these Terms. Where reasonable, we will give you notice and a chance to cure the issue first.

On termination, your data is permanently deleted (see the Privacy Policy for retention details).

12. Changes to these Terms

We may update these Terms. Material changes will be announced at least 14 days before they take effect, by email and in-app notice. Continuing to use the Service after the effective date means you accept the updated Terms.

13. Governing law and disputes

These Terms are governed by the laws of the State of Michigan, USA, without regard to its conflict-of-law rules.

Any dispute that cannot be resolved by good-faith email correspondence shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, in Wayne County, Michigan, or, if you prefer, in your local jurisdiction. Either party may seek injunctive relief in a court of competent jurisdiction.

You agree that disputes will be resolved on an individual basis. Class actions are not permitted.

14. Miscellaneous

If any provision of these Terms is held unenforceable, the rest remains in effect. These Terms are the entire agreement between you and Hindsight regarding the Service. We may assign these Terms in connection with a merger, acquisition, or sale of assets; you may not assign them without our consent.
